What BP is claiming is that if fishermen choose not to talk part in the oil spill cleanup, BP will consider that as potential income declined and deduct it from their claims.
In other words, if you didn’t want to risk your health and expose yourself to their toxic waste, you’re going to suffer financially as a result.

Actually, this makes sense. Under ‘murican tort law, a plaintiff must attempt to mitigate damages they suffer from the defendant’s wrong.
So if the _best_ source of income for these fishermen is to fish and BP offers them 1/2 of what they’d profit for attending to the cleanup, they’d only have to pay the other half. If BP hadn’t fucked them over, they’d still be working and causing wear & tear on their boats, right?
They don’t _have_ to work for BP. If they could find another source of income (not likely), they’d have to do that.
